Your right britchick55!  Apple made this part of the nano cheap.  This is a number 1 complaint on blogs about this model.  It's either on of the volume or sleep button that usually get stuck.

The reason for this is simply wear on the small dome switch inside.  Luckily it can be replaced.

I used a online repair shop named [http://www.ipodrefresh.com|iRefresh].  They sell the part and install it if you want.
